Terms of Use

These terms are an agreement between you and Elle Rosegold Studio ("we" or "us"). They cover your use of ElleMotion, our clip studio for photographers. By creating an account or using ElleMotion, you agree to them. If you don't agree, please don't use ElleMotion.

1. What ElleMotion does

ElleMotion finds face-forward moments in your videos and turns them into short clips. It runs in your web browser. Your videos are read and edited on your own device. We never upload, store, or see them. The same goes for any music you add.

2. Your account

• You sign in with your email address and a one-time code. Anyone who can read your email can sign in, so keep your email account secure.
• An account is for one person. Please don't share your sign-in or your membership.
• You must be at least 18 and able to enter a contract to use ElleMotion.
• You're responsible for activity under your account.

3. Free trial

Each new account includes 3 free exports. An export counts when you save a new clip to your device. Saving the same clip again is free. The trial is one per person. We may end trials that use extra accounts to get around this limit.

4. Founding plans and billing

• Monthly: $9 a month. Yearly: $97 a year. Lifetime: $149, paid once, limited to 100 members.
• Every plan includes unlimited exports, every update, and priority email support.
• Prices are in US dollars. Sales tax may be added where the law requires it.
• Monthly and yearly plans renew automatically until you cancel. You can cancel anytime under Manage billing. Your access continues until the end of the period you paid for.
• If a renewal payment fails, Stripe tries your card again. Your access stays on for up to two weeks while it does. Update your card under Manage billing to keep it going.
• We won't raise the price of an active founding membership. If your membership ends, the prices in effect at that time apply if you rejoin.
• We may change prices for new members at any time.
• Stripe processes all payments. We never see or store your full card number.

5. Lifetime membership

A lifetime membership is one payment for ElleMotion and all its updates, for as long as we offer ElleMotion. It includes unlimited exports. Separate products or paid add-ons we may offer later aren't included. We sell up to 100 lifetime memberships. Each one is for one person and can't be transferred. If we ever retire ElleMotion, we'll give lifetime members at least 60 days' notice by email.

Founding gift. The first ten lifetime members, in order of payment, get a free SmallRig Magnetic Phone Mount (model 5156). It fits iPhone 12 and newer, and any phone with a MagSafe-style magnetic case or ring. We ship it free within the US after your 14-day refund window ends, and we'll email you for your address. If one of the first ten gets a refund or can't receive US shipping, the next lifetime member gets the gift. If that model is no longer available, we'll send a similar mount.

6. Refunds

• Monthly plans: cancel anytime. We don't refund partial months.
• Yearly and lifetime plans: email us within 14 days of purchase for a full refund.
• A refund ends the membership it covers.

7. Your videos and your clients

• Your videos and clips belong to you.
• You're responsible for having the rights to every video you use, including permission from the people in it. Please follow your model releases and client agreements when you share clips.
• You're responsible for having the rights to any music you add to a clip. Some apps mute songs you don't have the rights to.
• ElleMotion processes video only on your device. We don't receive copies.

8. Fair use

Please don't:

• share, resell, or rent your account or ElleMotion;
• try to get around the free trial, plan limits, or sign-in;
• copy, modify, or reverse engineer ElleMotion's code, except as the open-source licenses on our credits page allow;
• use ElleMotion for anything illegal or to harm anyone.

9. Our work

ElleMotion's name, design, and code belong to Elle Rosegold Studio, except for the open-source parts. Those are used under their own licenses, listed on our Open-source credits page. Nothing in these terms limits your rights under those licenses.

Your ideas. If you send us an idea or feedback, we may use it to improve ElleMotion, without any obligation to you.

10. Changes and availability

We keep improving ElleMotion, so features may change. We may pause the service for maintenance or updates. ElleMotion needs a modern browser and works best in Chrome on a laptop or desktop. Results depend on your device and your footage.

11. No warranty

ElleMotion is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that ElleMotion will be error-free or uninterrupted, or that every clip will suit your needs. Please always keep your original files.

12. Limits on liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business. Our total liability for any claim about ElleMotion is limited to the amount you paid us in the 12 months before the claim.

13. Ending your account

You can stop using ElleMotion anytime, and you can email us to delete your account. We may suspend or close accounts that break these terms. If we close your account without cause, we'll refund any unused prepaid time.

14. Governing law

The laws of the State of Texas govern these terms, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas.

15. Changes to these terms

We may update these terms. We'll post the new version here with a new effective date. If a change is significant, we'll email you before it takes effect. Using ElleMotion after a change takes effect means you accept it.
